Findlay Creek Farmstead Event Entry Waiver
Release of Liability, Assumption of Risk, and Indemnity Agreement
Please read carefully before agreeing and submitting this form.
By entering Findlay Creek Farmstead and participating in any farm visit, Saturday event, petting farm visit, private visit, dog visit, volunteer activity, farm tour, seasonal event, or related activity, I confirm that I have read, understood, and agree to this waiver.
I understand that Findlay Creek Farmstead is an outdoor farm property. Farms include natural, animal-related, weather-related, and property-related risks. These risks may be obvious or hidden, expected or unexpected, and may result in injury, illness, allergic reaction, property damage, disability, or death.
These risks include, but are not limited to: uneven ground, mud, gravel, grass, ice, snow, wet surfaces, pathways, fields, barns, fences, gates, parking areas, animals, animal bites, scratches, kicks, sudden movements, allergic reactions, manure, hay, straw, dust, pollen, insects, ticks, bacteria, germs, tools, equipment, vehicles, trailers, tractors, ponds, water areas, fire pits, picnic areas, outdoor spaces, weather conditions, public gatherings, and the actions of other visitors, children, guests, volunteers, staff, contractors, vendors, or third parties.
I understand that farm animals can be unpredictable, even when they appear calm, friendly, trained, or familiar with people.
I am entering the property voluntarily. I freely accept and assume all risks connected with my entry, attendance, participation, and presence at Findlay Creek Farmstead.
To the fullest extent permitted by law, I release, waive, and forever discharge Findlay Creek Farmstead, its owners, operators, employees, volunteers, contractors, animal handlers, vendors, representatives, agents, property owners, successors, and assigns from any and all claims, demands, actions, damages, injuries, illnesses, losses, expenses, legal costs, property damage, disability, death, or liability arising from or connected to my entry onto the property, participation in any event or activity, interaction with animals, use of the premises, or presence at Findlay Creek Farmstead.
This release includes claims connected to negligence, occupiers’ liability, premises conditions, animal behaviour, event operation, supervision, failure to warn, failure to inspect, failure to maintain, or any other claim connected to my visit, to the fullest extent permitted by law.
I agree to follow all posted signs, safety rules, and instructions from Findlay Creek Farmstead staff, volunteers, or representatives. I agree not to enter restricted areas, open gates, climb fences, chase animals, feed animals without permission, touch animals without permission, disturb equipment, or act in a way that creates risk to myself, others, animals, staff, or property.
If I am attending with children or minors, I confirm that I am responsible for supervising them at all times. I understand that children must remain under adult supervision and that I am responsible for their actions, safety, and behaviour while on the property.
I understand that the farm may include exposure to animals, hay, straw, dust, pollen, insects, manure, outdoor conditions, food, beverages, and other allergens or irritants. I am responsible for determining whether I, or any minor attending with me, can safely attend. I am also responsible for carrying any required medication, including allergy medication, inhalers, or EpiPens.
In the event of an emergency, I authorize Findlay Creek Farmstead staff, volunteers, or representatives to contact emergency services. I understand that I am responsible for any ambulance, medical, hospital, or related costs connected to my attendance or the attendance of any minor under my supervision.
I understand that I am responsible for my own belongings, including vehicles, phones, wallets, bags, clothing, strollers, food, drinks, and personal items. Findlay Creek Farmstead is not responsible for lost, stolen, damaged, or misplaced property.
I understand that photos and videos may be taken during events or visits for promotional, social media, website, advertising, security, or record-keeping purposes. I grant Findlay Creek Farmstead permission to use photos or videos in which I or minors under my supervision may appear, unless I notify staff in writing before entering the event area.
I agree to indemnify and hold harmless Findlay Creek Farmstead and the released parties from any claims, damages, losses, legal costs, or expenses arising from my conduct, my failure to follow rules, my interaction with animals or property, or the conduct of any minor or guest under my supervision.
I understand that no farm, animal interaction, outdoor event, or public gathering can be guaranteed to be completely free from risk. I confirm that I am signing this waiver voluntarily and that I understand I am giving up certain legal rights, including the right to sue, to the fullest extent permitted by law.
This waiver is governed by the laws of Ontario and the applicable laws of Canada. If any part of this waiver is found to be invalid or unenforceable, the remaining parts shall continue to apply.
